The Scott-Morgan Foundation’s Terms of Service - Updated: August 16, 2024

 

These Scott-Morgan Foundation Terms of Service (“Terms”) are between you and The Scott-Morgan Foundation (“the Scott-Morgan Foundation,” “we,” “us,” or “our”).

 

Compliance with ElevenLabs Inc.’s Terms of Use 

You agree to comply with all terms and conditions outlined in ElevenLabs' Terms of Use, as may be amended occasionally.

 

Eligibility for Registration 

By signing up, you represent and warrant that you are either an individual diagnosed with Amyotrophic Lateral Sclerosis (“ALS”) or a caretaker of an individual diagnosed with ALS.

 

Voice Recipient Feedback

As part of receiving a free ElevenLabs voice from the Scott-Morgan Foundation, you will be asked, 'What would having an ElevenLabs voice at no extra cost mean for you? Please share some of your story and how this voice could impact you.' By agreeing to “Extend my gratitude and share my response with ElevenLabs,” your response to this question may be shared anonymously with ElevenLabs employees to help them understand the impact of their technology. Your name and personal information will not be included in your response. 

Your decision will not affect your eligibility to receive or use the voice.

 

Right to Revoke Access 

We reserve the right to revoke access to the API and associated services at any time, without prior notice or liability, for any reason, including but not limited to violations of the terms and conditions of this agreement or any applicable laws and regulations.

 

Privacy of Information

You agree that all information, including protected health information (“PHI”), audio files, and video files (“information” or “data”), is provided voluntarily, used, and released to authorized third-parties with your permission.

 

PHI will be stored with the Scott-Morgan Foundation on the HIPAA-compliant Google Suite. You agree to release your PHI to ElevenLabs for eligibility verification by agreeing to these terms. The Scott-Morgan Foundation will not share this data with any third party other than ElevenLabs. You consent to this storage, access, and release by using the services.

Termination of Agreement

Either party may terminate this agreement at any time by providing written notice to the other party. Upon termination, all rights and licenses granted under this agreement will immediately terminate.

 

Severability

If any provision of this agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of this agreement shall remain in full force and effect. The parties agree to negotiate in good faith to replace any invalid, illegal, or unenforceable provision with a valid, legal, and enforceable provision that carries out the parties’ original intent.

 

By signing this Agreement, you certify that you have read and fully understand the contents of this document. You also agree that you are not relying on any statements or representations of the Scott-Morgan Foundation. This document shall be binding upon you.
